USER AGREEMENT AND GENERAL TERMS OF WEBSITE USE


This User Agreement and General Terms of Website Use (hereinafter referred to as the “Terms”) define and govern the legal relationship arising between EVENT LAB PRODUCTION Limited Liability Company and persons using the Website.

DEFINITIONS AND RULES OF INTERPRETATION

1. Website means the online resource eventlabproduction.com, including all of its pages, subsections, design, texts, images, video materials, graphic elements, software solutions and other content through which the User may obtain information about PORTAL Music Fest and purchase tickets and/or Additional Services.

2. Festival / Event means PORTAL Music Fest, an international open-air music festival to be held on 11 October 2026 at the Yerevan Hippodrome, located at 37/5 Shirak Street, Yerevan, Republic of Armenia, at the times and under the conditions specified on the relevant Event page.

3. User means any natural person or legal entity that accesses or uses the Website, completes a form, places an Order or purchases a Ticket.

4. Ticket means a document, including an electronic digital document, confirming the User’s right to attend the Festival in accordance with the terms applicable to the relevant Ticket.

5. Electronic Ticket means a digital Ticket containing a QR code or another identifying code, sent to the User’s email address and/or made available on the Order page.

6. Order means an application submitted by the User through the Website for the purchase of a Ticket and/or an Additional Service.

7. Payment Provider means a bank or payment institution through which online payment is processed.

8. Identification Code means a QR code, barcode, Order number or other data used to identify a Ticket and/or an Order.

9. Additional Service means any supplementary service published on the Website, including, without limitation, a transfer service.

10. Transfer means a transportation service offered on the Website separately or together with a Ticket and subject to its own terms, schedule and departure points.

Unless the context requires otherwise, words defined in the singular shall also include the plural and vice versa. A reference to any clause of these Terms shall mean a reference to that specific clause. All headings are included solely for ease of reading and shall not affect the interpretation of these Terms.

GENERAL PROVISIONS

1. These Terms apply in all cases involving use of the Website, receipt of information about the Festival, placement of an Order, purchase of a Ticket, ordering of Additional Services and entry into legal relations with the Organizer by electronic means.

2. By accessing the Website, placing an Order, clicking “Continue”, “Order”, “Buy”, “Pay” or any button of similar meaning, and by making a payment, the User confirms that the User has fully read, understood and unconditionally accepted these Terms, as well as the Privacy Policy and the Refund and Cancellation Policy published on the Website.

3. The Organizer may amend these Terms by publishing a new version on the Website. The updated version shall apply to Orders placed after its publication unless the updated version expressly provides otherwise.

4. If special terms are stated on the page of a particular event, in the description of a Ticket or in the description of an Additional Service published on the Website, such special terms shall prevail over these general Terms with respect to the relevant service.

LEGAL CAPACITY OF THE USER

1. By accepting these Terms, the User confirms that the User has the legal capacity and authority required to use the Website, place an Order and make payment.

2. If the User acts on behalf of a legal entity, the User confirms that the User has all powers necessary to act on behalf of that legal entity.

3. If age or other restrictions apply to a particular Ticket, zone or service, such restrictions shall be published on the relevant Event page and shall be binding on the User.

USE OF THE WEBSITE AND PLACEMENT OF AN ORDER

1. The description, price and other material terms of Tickets and services stated on the relevant Event page of the Website shall be deemed a published offer unless expressly stated otherwise on that page.

2. To purchase a Ticket, the User must:
a) select the relevant Ticket and/or Additional Service;
b) provide the required information;
c) verify the accuracy of the information entered;
d) correct or amend the information, where necessary, before proceeding to payment;
e) confirm the intention to place the Order.

3. An Order shall be deemed duly placed when the User has completed all mandatory fields, confirmed the selection and proceeded to payment.

4. The User must provide accurate, complete and up-to-date information. The Organizer shall not be liable for problems resulting from an incorrectly entered email address, telephone number, name or other information.

5. The Organizer may suspend or reject an Order where there are reasonable grounds to suspect fraud, false information, suspicious payment activity, a duplicate Order, a payment dispute or other security risks.

PAYMENT PROCEDURE

1. Ticket and service prices shall be published on the Website. Unless otherwise specified, prices shall be stated in Armenian drams.

2. Payment may be made only by the payment methods available on the Website through the relevant Payment Provider.

3. If payment is not confirmed or the transaction is rejected by the bank or Payment Provider, the Order shall be deemed incomplete and the Ticket shall be deemed unsold.

4. The Organizer does not retain full bank card details where such details are entered in the secure payment environment of a bank or Payment Provider.

5. The Organizer shall not be liable for technical failures, delays or rejections by a bank, payment system or Payment Provider to the extent that such matters are beyond the Organizer’s control.

6. The User is responsible for the lawful use of the payment instruments used by the User.

ISSUANCE AND USE OF ELECTRONIC TICKETS

1. Unless otherwise stated on the Website or in the description of a particular service, Tickets shall be issued electronically.

2. Following successful completion of payment, the Electronic Ticket shall be sent to the email address provided by the User and/or made available in the Order confirmation message.

3. If the Electronic Ticket is not received within 30 minutes, the User must check the Spam, Junk and Promotions folders of the User’s email account and, where necessary, contact info@eventlabpro.com.

4. A QR code, barcode or other Identification Code confirms the authenticity of a Ticket. As a general rule, one code permits one admission, unless otherwise stated in the description of the relevant Ticket.

5. The User must keep the Electronic Ticket secure and must not allow identification details to become accessible to unauthorized third parties.

6. If the Identification Code of the same Ticket is presented more than once, only the first successful scan may be accepted as valid unless the Organizer decides otherwise.

7. The resale of Tickets for commercial purposes, including resale at a price exceeding the face value, is prohibited. If such conduct is identified, the Organizer may invalidate the relevant Ticket without a refund.

8. If a Ticket is personalized, or if the Organizer reasonably suspects fraud, duplication or unauthorized transfer, proof of identity may be required at the entrance.

9. If a Transfer is included with a Ticket, the departure point, schedule and other rules shall be published on the Website and/or communicated separately. In the event of late arrival or failure to appear for the Transfer, the service shall be deemed unused and no automatic right to a refund shall arise, except in the cases provided for in the Refund and Cancellation Policy.

ADMISSION, SECURITY AND CONDUCT RULES

1. Security screening may be conducted upon entry to the Festival grounds.

2. The Organizer may deny or restrict admission to persons who:
a) present a threat to their own safety or the safety of others;
b) present a forged, altered or invalid Ticket;
c) breach these Terms or lawful instructions of staff;
d) are visibly under the severe influence of alcohol or narcotic substances;
e) display aggressive, abusive or dangerous behavior.

3. Without the Organizer’s specific authorization, it is prohibited to bring weapons, sharp or dangerous objects, explosives or pyrotechnic materials, glass containers, narcotic or other illegal substances, or any item capable of posing a danger to persons or property onto the Festival grounds.

4. The use of professional photography, video recording or audio recording equipment, as well as unmanned aerial vehicles, may be prohibited without accreditation.

5. Unless separately permitted by the Organizer, bringing outside food, beverages or other items onto the Festival grounds may be restricted.

6. By attending the Festival, the User acknowledges that the Event is held outdoors and may be affected by weather conditions, large crowds, high sound levels, lighting effects, ground and environmental conditions, and other objective factors.

7. Photography and video recording may take place during the Festival. By attending the Event, the User agrees that the User’s image may appear in informational, news and advertising materials of the Organizer and its partners without additional compensation, to the extent permitted by law.

CHANGES, POSTPONEMENT OR CANCELLATION OF THE EVENT

1. The Organizer may, where necessary, change individual elements of the program, the lineup of artists, the order of performances, the schedule, the arrangement of zones, the order in which services are provided and other technical components of the Event.

2. A partial change involving an artist, presenter, DJ performance, part of the program, a stage or the schedule shall not in itself constitute cancellation of the Festival and shall not automatically create a right to a refund unless the Organizer publishes a decision to the contrary.

3. If the Event is postponed, relocated or cancelled, the Organizer shall publish the relevant information on the Website and, where possible, send notice using the contact details provided by the User.

4. In the event of cancellation, postponement or relocation of the Event, the Refund and Cancellation Policy published on the Website shall apply.

5. The Organizer shall not be liable for the User’s travel, accommodation or food expenses, loss of working time, lost opportunities or other indirect expenses unless otherwise expressly required by law.

6. In the event of force majeure, including natural disasters, fire, epidemics, hostilities, mass disorder, government restrictions, large-scale communications failures or power outages, the Organizer shall act in accordance with applicable law and the published policies.

PERSONAL DATA

1. The collection and processing of the User’s personal data shall be governed by the Privacy Policy published on the Website, which forms an integral part of these Terms.

2. By placing an Order and/or completing a form, the User agrees that the User’s data may be processed for the purposes of fulfilling the Order, issuing the Ticket, providing customer support, ensuring security, processing refunds and complying with legal obligations.

3. If the User provides personal data relating to a third party, the User confirms that the User is entitled to do so and/or has obtained the relevant person’s consent.

4. The User may submit a request for information, correction, restriction of processing, deletion of personal data or withdrawal of consent in the manner provided for in the Privacy Policy.

COMMUNICATION

1. The email address and telephone number provided by the User shall be regarded as valid means of communication.

2. Notices, notifications and messages sent by the Organizer to the contact details provided by the User shall be deemed duly sent.

3. The User must ensure that the User’s contact details are accurate and up to date. The User shall bear the consequences of failing to provide timely notice of changes to such contact details.

LIMITATION OF LIABILITY

1. The Organizer shall not be liable for lost, stolen or damaged personal belongings unless the loss or damage was directly caused by the Organizer.

2. To the extent permitted by law, the Organizer shall not be liable for the consequences of temporary technical unavailability of the Website or payment environment, failures in services provided by third parties, or force majeure.

3. The User must comply with the rules of conduct concerning other attendees, staff and the venue. Any damage caused by the User shall be compensated in accordance with applicable law.

COMPLAINTS, DISPUTE RESOLUTION AND GOVERNING LAW

1. All complaints and requests must initially be submitted to the Organizer at info@eventlabpro.com or by telephone at +37441403046.

2. The Organizer shall seek to respond to complaints within a reasonable period, but no later than 10 business days, unless the matter requires a longer documentary or technical review.

3. If a dispute is not resolved out of court, it shall be subject to the jurisdiction of the competent courts of the Republic of Armenia in accordance with the laws of the Republic of Armenia.

4. These Terms shall be governed by the laws of the Republic of Armenia.

FINAL PROVISIONS

1. If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

2. These Terms shall enter into force upon publication on the Website.

3. The Privacy Policy and the Refund and Cancellation Policy form integral parts of these Terms.


PRIVACY POLICY

GENERAL PROVISIONS

1. This Policy applies to persons who use the Website, place an Order, purchase a Ticket, complete forms, contact the Organizer or otherwise provide their data.

2. Personal data shall be processed in accordance with the laws of the Republic of Armenia and this Policy.

3. This Policy does not apply to third-party websites or services that may be linked from the Website or through which separate actions are performed, such as payment or receipt of a third-party service, where separate terms and policies apply to the relevant service.

DATA WE MAY COLLECT

1. Contact and identification data: first name, last name, email address, telephone number and, in certain cases, place of residence or other information where necessary for the provision of a specific service.

2. Order data: Order number, type and quantity of Tickets purchased, Additional Services, payment status, and requests for refunds or amendments.

3. Technical data: Internet Protocol address, device type, browser type, operating system, date and time of visit, language settings, cookie-related data and general usage statistics.

4. Communication data: the content of emails, calls, messages or requests sent to us where You voluntarily provide such information.

5. Transfer or other Additional Service data: information that may be required to arrange the relevant service.

6. Bank card data: as a general rule, the Organizer does not collect or retain full details of Your card where payment is made in the secure payment environment of a bank or Payment Provider.

PURPOSES OF DATA PROCESSING

We may process Your data for the following purposes:

1. placement of an Order, confirmation of payment and issuance of an Electronic Ticket;

2. arrangement of Additional Services, including Transfers;

3. customer support and consideration of requests and complaints;

4. processing requests for refunds, cancellations and amendments;

5. prevention of fraud, counterfeit Tickets, duplicate Orders and security risks;

6. compliance with legal, tax, accounting and contractual obligations;

7. sending important notices relating to the Event, schedule, venue, admission rules or purchased services;

8. statistical and analytical purposes and improvement of services;

9. sending marketing communications only to the extent permitted by law and/or where the relevant consent has been obtained.

LEGAL BASES FOR DATA PROCESSING

1. Establishing and performing contractual relations with You, including the sale of Tickets and provision of services.

2. Your consent, where separate consent is required for the relevant processing.

3. Compliance with the Organizer’s legal obligations.

4. The Organizer’s legitimate interests, including the secure operation of the Website, prevention of misuse, improvement of service quality and customer support, while respecting Your rights and freedoms.

RECIPIENTS OF DATA

1. A Payment Provider or bank, for the purpose of processing and confirming payment or issuing a refund.

2. Technical service providers, for website hosting, email delivery, data storage, security, analytics, customer relationship management systems and other technical support.

3. Transport providers or other partners, solely to the extent necessary to arrange the relevant service.

4. Government authorities or authorized organizations, where disclosure is required by law or pursuant to a lawful and substantiated request.

5. Our employees and authorized persons, solely to the extent necessary for the performance of their duties.

We do not sell Your data to third parties.

DATA RETENTION PERIODS

1. Personal data shall be retained for as long as necessary to fulfil the purposes for which it was collected.

2. Order, payment and accounting data may be retained for longer where required by law or necessary for the consideration of disputes and claims.

3. Where data processing is based on Your consent, the data may be retained until the consent is withdrawn, unless otherwise provided by law.

4. Once the purpose of processing has been fulfilled, the data shall be deleted, anonymized or otherwise cease to be used in a manner permitted by law.

COOKIES AND ANALYTICAL TOOLS

1. The Website may use cookies and similar technologies for the purposes of:
a) ensuring the proper operation of the Website;
b) remembering Your preferences;
c) obtaining general statistics concerning use of the Website;
d) improving content and user experience.

2. You may restrict or disable cookies in Your browser settings; however, as a result, certain Website functions may be limited or may not operate properly.

YOUR RIGHTS

You have the right to:

4. request restriction of processing, blocking or deletion of data in the cases provided by law;

DATA SECURITY

1. The Organizer takes reasonable organizational and technical measures to protect personal data against unauthorized access, loss, alteration, leakage or other unlawful processing.

2. Despite the measures taken, no data transmitted over the Internet or stored in electronic systems can be considered absolutely secure. For this reason, we cannot guarantee one hundred percent security; however, we act in good faith and implement appropriate protective measures.

THIRD-PARTY DATA

If You provide us through the Website with data relating to a third party, You confirm that You have obtained that person’s consent or otherwise have a lawful right to provide the data and permit its processing for the purposes set out in this Policy.

REFUND AND CANCELLATION POLICY

GENERAL PROVISIONS

1. This Policy forms an integral part of the User Agreement published on the Website.

2. Refunds shall be made only to the extent and in the circumstances expressly provided for in this Policy, by law or by a separate published decision of the Organizer.

3. If special refund terms are stated in the description of a particular Ticket or service on the Website, those special terms shall prevail over this general Policy with respect to the relevant offer.

REFUND OF A TICKET AT THE USER’S REQUEST

1. If the User wishes to cancel a purchased Ticket at the User’s own initiative, a refund request may be submitted no later than 30 (thirty) days before the start of the Festival.

2. If the request is submitted within the period specified in clause 1 of this section, the face value of the Ticket shall be refunded less any non-refundable fees charged by the bank or Payment Provider and/or the cost of services actually provided, where such fees or costs apply.

3. If fewer than 30 days remain before the start of the Festival, the Ticket shall not be refundable, except in the other circumstances provided for in this Policy.

4. No refund shall be made where:
a) the Ticket has already been used or its QR code or Identification Code has been scanned;
b) the User failed to attend the Event, arrived late or voluntarily declined admission;
c) admission was denied due to the User’s breach of the rules, presentation of a forged or invalid Ticket, dangerous conduct or breach of security requirements;
d) unauthorized resale, duplication, fraud or other misuse involving the Ticket has been identified.

5. A partial change to individual elements of the Festival program, the lineup of artists, the arrangement of stages, the schedule or the order of performances shall not in itself constitute grounds for a refund unless the Organizer specifically establishes a different procedure.

REFUND OF ADDITIONAL SERVICES

1. Where a Transfer or other Additional Service is purchased together with a Ticket, the refund for that service may be calculated separately.

2. A refund for a Transfer may be requested no later than 72 (seventy-two) hours before the service is due to commence.

3. The cost of a Transfer cancelled fewer than 72 hours before commencement of the service shall not be refundable, except where the service was not provided for reasons attributable to the Organizer or a partner engaged by the Organizer.

4. Failure to use the Transfer, late arrival or failure to appear at the departure point on time shall not in itself create a right to a refund.

CANCELLATION OF THE FESTIVAL

1. If PORTAL Music Fest is cancelled in its entirety by decision of the Organizer or due to circumstances as a result of which the Event does not take place, the User shall be entitled to request a refund of the face value of the Ticket.

2. If only the performance of an individual artist, the program of an individual stage or a separate part of the program is cancelled, while the Event as a whole still takes place, this shall not automatically be treated as full cancellation of the Event.

3. In the event of cancellation, a refund shall be made using the same payment method used for the original payment, unless a different method is technically required or agreed by the parties.

4. Refund processing may take up to 10 business days from the official commencement of the refund procedure. The actual time required for the funds to be credited to a card or account may depend on the bank or Payment Provider.

POSTPONEMENT OR CHANGE OF DATE

1. If the Event is postponed or rescheduled to another date, purchased Tickets shall remain valid for the newly announced date unless the Organizer publicly establishes a different procedure.

2. If the User cannot attend the Event on the new date, the User may submit a refund request within 7 (seven) calendar days following the official announcement of the new date.

3. In such a case, the face value of the Ticket shall be refunded less any non-refundable fees charged by the bank or Payment Provider and/or the cost of services actually provided, where such fees or costs apply.

4. Changes to the venue, admission time or an individual part of the program shall be assessed in accordance with the specific conditions published by the Organizer and shall not automatically create a right to a refund where the Event as a whole still takes place.

REFUND REQUEST PROCEDURE

1. A refund request must be submitted electronically to info@eventlabpro.com.

2. The request should, where possible, include:
a) the Order number;
b) the purchaser’s first and last name;
c) the email address or telephone number used when placing the Order;
d) the grounds for the refund;
e) payment confirmation details or supporting evidence, if available.

3. The Organizer may request additional information or evidence for identification purposes, fraud prevention or verification of the grounds for a refund.

4. Requests containing incomplete, contradictory or manifestly false information may be rejected or left pending until the required clarification is provided.

PAYMENT DISPUTES

1. If the User initiates a chargeback procedure or otherwise disputes a payment through a bank or payment system, the Organizer may temporarily suspend the relevant Ticket or Order until the dispute has been finally resolved.

2. Where there are reasonable grounds to suspect fraud or misuse, the Organizer may refuse a refund or pursue legal remedies available under applicable law.

2. Payment may be made only by the payment methods available on the Website through the relevant Payment Provider.

3. If payment is not confirmed or the transaction is rejected by the bank or Payment Provider, the Order shall be deemed incomplete and the Ticket shall be deemed unsold.

4. The Organizer does not retain full bank card details where such details are entered in the secure payment environment of a bank or Payment Provider.

5. The Organizer shall not be liable for technical failures, delays or rejections by a bank, payment system or Payment Provider to the extent that such matters are beyond the Organizer’s control.

6. The User is responsible for the lawful use of the payment instruments used by the User.

ISSUANCE AND USE OF ELECTRONIC TICKETS

1. Unless otherwise stated on the Website or in the description of a particular service, Tickets shall be issued electronically.

2. Following successful completion of payment, the Electronic Ticket shall be sent to the email address provided by the User and/or made available in the Order confirmation message.

3. If the Electronic Ticket is not received within 30 minutes, the User must check the Spam, Junk and Promotions folders of the User’s email account and, where necessary, contact info@eventlabpro.com.

4. A QR code, barcode or other Identification Code confirms the authenticity of a Ticket. As a general rule, one code permits one admission, unless otherwise stated in the description of the relevant Ticket.

5. The User must keep the Electronic Ticket secure and must not allow identification details to become accessible to unauthorized third parties.

6. If the Identification Code of the same Ticket is presented more than once, only the first successful scan may be accepted as valid unless the Organizer decides otherwise.

7. The resale of Tickets for commercial purposes, including resale at a price exceeding the face value, is prohibited. If such conduct is identified, the Organizer may invalidate the relevant Ticket without a refund.

8. If a Ticket is personalized, or if the Organizer reasonably suspects fraud, duplication or unauthorized transfer, proof of identity may be required at the entrance.

9. If a Transfer is included with a Ticket, the departure point, schedule and other rules shall be published on the Website and/or communicated separately. In the event of late arrival or failure to appear for the Transfer, the service shall be deemed unused and no automatic right to a refund shall arise, except in the cases provided for in the Refund and Cancellation Policy.

ADMISSION, SECURITY AND CONDUCT RULES

1. Security screening may be conducted upon entry to the Festival grounds.

2. The Organizer may deny or restrict admission to persons who:
a) present a threat to their own safety or the safety of others;
b) present a forged, altered or invalid Ticket;
c) breach these Terms or lawful instructions of staff;
d) are visibly under the severe influence of alcohol or narcotic substances;
e) display aggressive, abusive or dangerous behavior.

3. Without the Organizer’s specific authorization, it is prohibited to bring weapons, sharp or dangerous objects, explosives or pyrotechnic materials, glass containers, narcotic or other illegal substances, or any item capable of posing a danger to persons or property onto the Festival grounds.

4. The use of professional photography, video recording or audio recording equipment, as well as unmanned aerial vehicles, may be prohibited without accreditation.

5. Unless separately permitted by the Organizer, bringing outside food, beverages or other items onto the Festival grounds may be restricted.

6. By attending the Festival, the User acknowledges that the Event is held outdoors and may be affected by weather conditions, large crowds, high sound levels, lighting effects, ground and environmental conditions, and other objective factors.

7. Photography and video recording may take place during the Festival. By attending the Event, the User agrees that the User’s image may appear in informational, news and advertising materials of the Organizer and its partners without additional compensation, to the extent permitted by law.

CHANGES, POSTPONEMENT OR CANCELLATION OF THE EVENT

1. The Organizer may, where necessary, change individual elements of the program, the lineup of artists, the order of performances, the schedule, the arrangement of zones, the order in which services are provided and other technical components of the Event.

2. A partial change involving an artist, presenter, DJ performance, part of the program, a stage or the schedule shall not in itself constitute cancellation of the Festival and shall not automatically create a right to a refund unless the Organizer publishes a decision to the contrary.

3. If the Event is postponed, relocated or cancelled, the Organizer shall publish the relevant information on the Website and, where possible, send notice using the contact details provided by the User.

4. In the event of cancellation, postponement or relocation of the Event, the Refund and Cancellation Policy published on the Website shall apply.

5. The Organizer shall not be liable for the User’s travel, accommodation or food expenses, loss of working time, lost opportunities or other indirect expenses unless otherwise expressly required by law.

6. In the event of force majeure, including natural disasters, fire, epidemics, hostilities, mass disorder, government restrictions, large-scale communications failures or power outages, the Organizer shall act in accordance with applicable law and the published policies.

PERSONAL DATA

1. The collection and processing of the User’s personal data shall be governed by the Privacy Policy published on the Website, which forms an integral part of these Terms.

2. By placing an Order and/or completing a form, the User agrees that the User’s data may be processed for the purposes of fulfilling the Order, issuing the Ticket, providing customer support, ensuring security, processing refunds and complying with legal obligations.

3. If the User provides personal data relating to a third party, the User confirms that the User is entitled to do so and/or has obtained the relevant person’s consent.

4. The User may submit a request for information, correction, restriction of processing, deletion of personal data or withdrawal of consent in the manner provided for in the Privacy Policy.

COMMUNICATION

1. The email address and telephone number provided by the User shall be regarded as valid means of communication.

2. Notices, notifications and messages sent by the Organizer to the contact details provided by the User shall be deemed duly sent.

3. The User must ensure that the User’s contact details are accurate and up to date. The User shall bear the consequences of failing to provide timely notice of changes to such contact details.

LIMITATION OF LIABILITY

1. The Organizer shall not be liable for lost, stolen or damaged personal belongings unless the loss or damage was directly caused by the Organizer.

2. To the extent permitted by law, the Organizer shall not be liable for the consequences of temporary technical unavailability of the Website or payment environment, failures in services provided by third parties, or force majeure.

3. The User must comply with the rules of conduct concerning other attendees, staff and the venue. Any damage caused by the User shall be compensated in accordance with applicable law.

COMPLAINTS, DISPUTE RESOLUTION AND GOVERNING LAW

1. All complaints and requests must initially be submitted to the Organizer at info@eventlabpro.com or by telephone at +37441403046.

2. The Organizer shall seek to respond to complaints within a reasonable period, but no later than 10 business days, unless the matter requires a longer documentary or technical review.

3. If a dispute is not resolved out of court, it shall be subject to the jurisdiction of the competent courts of the Republic of Armenia in accordance with the laws of the Republic of Armenia.

4. These Terms shall be governed by the laws of the Republic of Armenia.

FINAL PROVISIONS

1. If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

2. These Terms shall enter into force upon publication on the Website.

3. The Privacy Policy and the Refund and Cancellation Policy form integral parts of these Terms.


PRIVACY POLICY

GENERAL PROVISIONS

1. This Policy applies to persons who use the Website, place an Order, purchase a Ticket, complete forms, contact the Organizer or otherwise provide their data.

2. Personal data shall be processed in accordance with the laws of the Republic of Armenia and this Policy.

3. This Policy does not apply to third-party websites or services that may be linked from the Website or through which separate actions are performed, such as payment or receipt of a third-party service, where separate terms and policies apply to the relevant service.

DATA WE MAY COLLECT

1. Contact and identification data: first name, last name, email address, telephone number and, in certain cases, place of residence or other information where necessary for the provision of a specific service.

2. Order data: Order number, type and quantity of Tickets purchased, Additional Services, payment status, and requests for refunds or amendments.

3. Technical data: Internet Protocol address, device type, browser type, operating system, date and time of visit, language settings, cookie-related data and general usage statistics.

4. Communication data: the content of emails, calls, messages or requests sent to us where You voluntarily provide such information.

5. Transfer or other Additional Service data: information that may be required to arrange the relevant service.

6. Bank card data: as a general rule, the Organizer does not collect or retain full details of Your card where payment is made in the secure payment environment of a bank or Payment Provider.

PURPOSES OF DATA PROCESSING

We may process Your data for the following purposes:

1. placement of an Order, confirmation of payment and issuance of an Electronic Ticket;

2. arrangement of Additional Services, including Transfers;

3. customer support and consideration of requests and complaints;

4. processing requests for refunds, cancellations and amendments;

5. prevention of fraud, counterfeit Tickets, duplicate Orders and security risks;

6. compliance with legal, tax, accounting and contractual obligations;

7. sending important notices relating to the Event, schedule, venue, admission rules or purchased services;

8. statistical and analytical purposes and improvement of services;

9. sending marketing communications only to the extent permitted by law and/or where the relevant consent has been obtained.

LEGAL BASES FOR DATA PROCESSING

1. Establishing and performing contractual relations with You, including the sale of Tickets and provision of services.

2. Your consent, where separate consent is required for the relevant processing.

3. Compliance with the Organizer’s legal obligations.

4. The Organizer’s legitimate interests, including the secure operation of the Website, prevention of misuse, improvement of service quality and customer support, while respecting Your rights and freedoms.

RECIPIENTS OF DATA

1. A Payment Provider or bank, for the purpose of processing and confirming payment or issuing a refund.

2. Technical service providers, for website hosting, email delivery, data storage, security, analytics, customer relationship management systems and other technical support.

3. Transport providers or other partners, solely to the extent necessary to arrange the relevant service.

4. Government authorities or authorized organizations, where disclosure is required by law or pursuant to a lawful and substantiated request.

5. Our employees and authorized persons, solely to the extent necessary for the performance of their duties.

We do not sell Your data to third parties.

DATA RETENTION PERIODS

2. Order, payment and accounting data may be retained for longer where required by law or necessary for the consideration of disputes and claims.

1. The Organizer takes reasonable organizational and technical measures to protect personal data against unauthorized access, loss, alteration, leakage or other unlawful processing.

2. Despite the measures taken, no data transmitted over the Internet or stored in electronic systems can be considered absolutely secure. For this reason, we cannot guarantee one hundred percent security; however, we act in good faith and implement appropriate protective measures.

THIRD-PARTY DATA

If You provide us through the Website with data relating to a third party, You confirm that You have obtained that person’s consent or otherwise have a lawful right to provide the data and permit its processing for the purposes set out in this Policy.

REFUND AND CANCELLATION POLICY

GENERAL PROVISIONS

1. This Policy forms an integral part of the User Agreement published on the Website.

2. Refunds shall be made only to the extent and in the circumstances expressly provided for in this Policy, by law or by a separate published decision of the Organizer.

3. If special refund terms are stated in the description of a particular Ticket or service on the Website, those special terms shall prevail over this general Policy with respect to the relevant offer.

REFUND OF A TICKET AT THE USER’S REQUEST

1. If the User wishes to cancel a purchased Ticket at the User’s own initiative, a refund request may be submitted no later than 30 (thirty) days before the start of the Festival.

2. If the request is submitted within the period specified in clause 1 of this section, the face value of the Ticket shall be refunded less any non-refundable fees charged by the bank or Payment Provider and/or the cost of services actually provided, where such fees or costs apply.

3. If fewer than 30 days remain before the start of the Festival, the Ticket shall not be refundable, except in the other circumstances provided for in this Policy.

4. No refund shall be made where:
a) the Ticket has already been used or its QR code or Identification Code has been scanned;
b) the User failed to attend the Event, arrived late or voluntarily declined admission;
c) admission was denied due to the User’s breach of the rules, presentation of a forged or invalid Ticket, dangerous conduct or breach of security requirements;
d) unauthorized resale, duplication, fraud or other misuse involving the Ticket has been identified.

5. A partial change to individual elements of the Festival program, the lineup of artists, the arrangement of stages, the schedule or the order of performances shall not in itself constitute grounds for a refund unless the Organizer specifically establishes a different procedure.

REFUND OF ADDITIONAL SERVICES

1. Where a Transfer or other Additional Service is purchased together with a Ticket, the refund for that service may be calculated separately.

2. A refund for a Transfer may be requested no later than 72 (seventy-two) hours before the service is due to commence.

3. The cost of a Transfer cancelled fewer than 72 hours before commencement of the service shall not be refundable, except where the service was not provided for reasons attributable to the Organizer or a partner engaged by the Organizer.

4. Failure to use the Transfer, late arrival or failure to appear at the departure point on time shall not in itself create a right to a refund.

CANCELLATION OF THE FESTIVAL

1. If PORTAL Music Fest is cancelled in its entirety by decision of the Organizer or due to circumstances as a result of which the Event does not take place, the User shall be entitled to request a refund of the face value of the Ticket.

2. If only the performance of an individual artist, the program of an individual stage or a separate part of the program is cancelled, while the Event as a whole still takes place, this shall not automatically be treated as full cancellation of the Event.

3. In the event of cancellation, a refund shall be made using the same payment method used for the original payment, unless a different method is technically required or agreed by the parties.

4. Refund processing may take up to 10 business days from the official commencement of the refund procedure. The actual time required for the funds to be credited to a card or account may depend on the bank or Payment Provider.

POSTPONEMENT OR CHANGE OF DATE

1. If the Event is postponed or rescheduled to another date, purchased Tickets shall remain valid for the newly announced date unless the Organizer publicly establishes a different procedure.

2. If the User cannot attend the Event on the new date, the User may submit a refund request within 7 (seven) calendar days following the official announcement of the new date.

3. In such a case, the face value of the Ticket shall be refunded less any non-refundable fees charged by the bank or Payment Provider and/or the cost of services actually provided, where such fees or costs apply.

4. Changes to the venue, admission time or an individual part of the program shall be assessed in accordance with the specific conditions published by the Organizer and shall not automatically create a right to a refund where the Event as a whole still takes place.

REFUND REQUEST PROCEDURE

1. A refund request must be submitted electronically to info@eventlabpro.com.

2. The request should, where possible, include:
a) the Order number;
b) the purchaser’s first and last name;
c) the email address or telephone number used when placing the Order;
d) the grounds for the refund;
e) payment confirmation details or supporting evidence, if available.

3. The Organizer may request additional information or evidence for identification purposes, fraud prevention or verification of the grounds for a refund.

4. Requests containing incomplete, contradictory or manifestly false information may be rejected or left pending until the required clarification is provided.

PAYMENT DISPUTES

1. If the User initiates a chargeback procedure or otherwise disputes a payment through a bank or payment system, the Organizer may temporarily suspend the relevant Ticket or Order until the dispute has been finally resolved.

2. Where there are reasonable grounds to suspect fraud or misuse, the Organizer may refuse a refund or pursue legal remedies available under applicable law.
